Negotiation and Settlement Before Litigation

The Right Approach to Dispute Resolution Can Save Time, Reduce Costs, and Preserve Business

Not every legal dispute needs to begin in court. Many disputes can be addressed through direct negotiation, amicable settlement, or mediation before moving to litigation. These approaches give the parties an opportunity to discuss the issues involved and reach an agreement that clearly addresses their rights and obligations while taking the nature of the dispute and the interests of the parties into consideration.

Effective settlement requires a clear understanding of the legal position, an assessment of the relevant rights and claims, and careful consideration of the available options. Settlement agreements should also be drafted clearly to protect the parties’ rights and reduce the possibility of future disputes. Where an amicable resolution is not appropriate or achievable, legal and judicial proceedings may be pursued according to the nature of the matter.

  • Negotiation: Assessing the parties’ claims and legal positions to identify possible areas of agreement.
  • Settlement: Drafting a clear agreement that defines the rights and obligations of the parties.
  • Litigation: Proceeding with legal action when an appropriate settlement cannot be reached.
